Recovered $2,000.00 in REAL ESTATE DEPOSIT dispute


The Background: The Plaintiff paid a deposit to the Defendant for a vacant apartment that was not ready to be occupied due to some repair required. 5 days later, the Plaintiff notified the Defendant that they would not be able to move into the apartment due to the Plaintiff’s partner being recently diagnosed with severe arthritis and would not be able to walk up and down stairs. The Plaintiff requested to have the deposit returned. The Defendant agreed; however, did not return the deposit, giving numerous excuses over a period of approximately 6 months.

Action:The Plaintiff retained Kevin R Hodge to represent their matter in Small Claim Court. Our Mississauga Paralegal drafted and filed Plaintiffs Claim against the Defendant for the refund of the deposit.

Plaintiff claimed:Compensatory damages $2,000.00.
General Damages: Interest and Cost of action.

Outcome: The Defendant reviewed the Plaintiffs Claim and contacted our Mississauga Paralegal to settle the matter. The Defendant sent a cheque in the amount of the amount claimed payable to the Plaintiff’s Representative and asked that the Plaintiff’s claim be withdrawn.
